Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of www.therouteplan.com, the linked product demo, and the early-access signup (together, the "Services"). The Services are operated under the name The Route Plan by Abhishek Deb, a sole proprietor in India ("The Route Plan", "Operator", "we", "us", or "our").

1. Scope of these Terms

These Terms apply only to the current public landing website, product demo, and early-access signup. The future rider application may include accounts, subscriptions, uploads, location sharing, or other features governed by additional or updated terms. We will present those terms before they apply.

2. Eligibility and users under 18

The Services do not contain adult content and may be accessed by users who ride bicycles, motorcycles, or other supported vehicles. If you are under 18, you may use the Services only with the involvement, supervision, and consent of a parent or lawful guardian. Your parent or guardian is responsible for reviewing these Terms with you. Users under 18 should not submit personal information without parent or guardian consent. We do not currently use automated age verification.

3. Early access and demo status

Joining the early-access list does not guarantee admission, a launch date, continued availability, pricing, or any particular feature. The demo, screenshots, statistics, scenarios, maps, routes, interfaces, and descriptions are previews intended to illustrate a proposed experience. They may use simulated data and may differ from the released product. We may add, remove, suspend, or change any part of the Services without notice.

4. Permitted use

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, lawful, non-commercial evaluation in accordance with these Terms.

5. Prohibited conduct

You must not:

• use the Services for unlawful, fraudulent, abusive, or harmful activity;
• impersonate another person or misrepresent your identity or affiliation;
• interfere with, disrupt, overload, probe, or bypass the security of the Services;
• scrape, crawl, copy, extract, or access the Services through automated means except as expressly permitted by us or standard search-engine instructions;
• reverse engineer, decompile, disassemble, or attempt to derive source code except where applicable law expressly permits it;
• introduce malware, harmful code, or content that infringes another person's rights;
• remove ownership, copyright, trademark, or attribution notices; or
• use the Services to build or promote a competing product using our protected material.

6. Safety, navigation, and riding disclaimer

The Route Plan is a planning and coordination aid. It does not replace rider judgment, training, supervision of minors, road awareness, official road signs, vehicle maintenance, protective equipment, weather checks, emergency services, or compliance with traffic and other applicable laws. Routes, stops, range estimates, live positions, alerts, and other information may be incomplete, delayed, inaccurate, unavailable, or unsafe for current conditions.

Do not interact with a device while riding or driving. Before and during any journey, you remain responsible for choosing a lawful and safe route, monitoring conditions, operating your vehicle safely, and obtaining appropriate permissions, licences, insurance, and adult supervision where applicable. In an emergency, contact the appropriate emergency service.

7. Intellectual property

The Services and their software, branding, logos, designs, text, graphics, interfaces, demonstrations, and other content are owned by the Operator or used with permission and are protected by applicable intellectual-property laws. "The Route Plan" and associated marks may not be used without prior written permission.

If you voluntarily provide ideas, suggestions, or feedback, you agree that we may use, reproduce, modify, publish, and commercialise that feedback without restriction or compensation. To the extent legally permitted, you assign to the Operator any intellectual-property rights in that feedback. Future user-uploaded routes, photographs, and other application content are outside the current Services and will be addressed in the terms presented with those features.

8. Third-party services and links

The Services may depend on or link to third parties, including analytics, email, hosting, cloud, authentication, map, and social-media providers. We do not control third-party services and are not responsible for their content, availability, security, or practices. Your use of a third-party service may be governed by its own terms and policies.

9. Privacy

Our Privacy Policy explains how we handle personal information in connection with the Services. By using the Services, you acknowledge that policy.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. We do not warrant that the Services will be uninterrupted, secure, accurate, complete, fit for a particular purpose, or free of errors or harmful components. No preview, statement, or communication creates a warranty unless expressly stated in a written agreement signed by the Operator. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent permitted by law, the Operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of data, profits, opportunity, goodwill, or use arising from or related to the Services. Our total liability relating to the current free Services will not exceed INR 1,000. These limits do not apply to liability that cannot be limited or excluded under applicable law.

12. Indemnity

To the extent permitted by law, you agree to indemnify and hold the Operator harmless from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the Services, your breach of these Terms, or your infringement of another person's rights.

13. Suspension and termination

We may restrict or terminate access to the Services where reasonably necessary to protect users, the Services, or third parties; investigate suspected misuse; comply with law; or enforce these Terms. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, liability limits, indemnity, and governing law.

14. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any rights or forums that cannot lawfully be excluded, the courts located in Bengaluru, Karnataka, India will have exclusive jurisdiction over disputes arising from or relating to the Services or these Terms.

15. Changes to these Terms

We may update these Terms as the Services or legal requirements change. We will publish the revised Terms here and update the effective or revision date. Your continued use after a change becomes effective constitutes acceptance of the revised Terms where permitted by law. If you do not agree to a change, stop using the Services.

16. General terms

If a provision is held unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent. We may assign these Terms as part of a transfer or reorganisation of the business. These Terms and the Privacy Policy form the entire agreement for the current Services.
